Dte raises queries about the merger proposal.

Subject : Merger of ASP cadre in to PS Gr. B cadre – Proposal regarding.

Sir,
Kindly refer to your letter No. GS/AIAIASP/Merger ASP/2013 dated 20.11.2013 and 21.04.2014 on the subject mentioned above.

2. In this regard, this is to inform that the proposal submitted by your Association has been examined in detail with the following observations:

(i)         It was intimated in the proposal that there is a matching saving for the proposal as there would be an additional expenditure of Rs. 66,86,100/- per annum against the saving of Rs. 69,25,100/- per annum. This means a net saving of Rs. 2,39,700/- per annum. However, while this may be true in the long run, at present there would be no matching saving, as pay will have to be protected for the 679 ASPs till they get promoted to PS Gr. B Grade, while additional expenditure of Rs. 66,86,100/- would start immediately Savings will start accruing only after the 679 ASPs working on the ASP posts downgraded to IPs get promoted to PS Gr. B Grade which will take a very long time. Thus, it is not correct to say that the case has matching savings.
(ii)        The proposed down gradation of 679 ASPs (Sub Division) to IP (Sub Division) would create technical problems as ASPs cannot be posted on IPs Posts. Otherwise, they would have to be reverted which is not permissible. The proposal, thus, would only be beneficial for the senior 1311 ASPs and at the same time detrimental to the remaining 679 ASPs who may suffer reversion. Further, on upgradation of the ASPs Posts to PS Gr. B there would be two or more Gr. B officers in Gr. B Divisions. Then, there would be a problem / issue of reporting and also that who amongst them would head the Division. This would ultimately create complicated situation and may not, thus, be administratively viable.
 
(Note :- the number of ASP Sub Divisions has been ascertained from the Circles and the matching savings have been re-calculated on the basis of information received from the Circles)

3. Therefore, it is requested to furnish your comments / clarifications on the above mentioned observations for further examination of the proposal at the earliest.

Circle News !!!

It is learnt that requisition for allotment of Seven (7) JTS officers to Punjab Circle has been sent to Directorate in the light of JTS Gr A DPC meeting held during the recent week. Punjab Circle is hoping that all the vacant JTS Gr A posts would be filled on regular basis thereafter. In view of rapid CBS roll out in the Circle, Directorate is likely to consider the demand and shall recoup and filled up the shortage.

Nagar Raajbhaashaa Karyaanvay Samitee, Patiala rewarded Mr Sunil Kumar 'Neel' CI Patiala.

Nagar Raajbhaashaa Karyaanvay Samitee, Patiala’s half-yerly meeting held at Income Tax Office, Patiala on 20th May, 2014 during which the prize distribution in respect of Hindi promotional events conducted in the 2nd half of year-2013 was also held in which Mr. Sunil Kumar, Inspector Posts (Public Grievances), Patiala Division has been awarded with the third prize for his following Hindi poem titled ‘Triskrit-Hindi’ which has also been published by the Samitee in the very first issue of its magazine named ‘Raajbhaashaa Darpan’, released during the said meet.

Issues taken by GS with Dte

Letter to Member (P) i/c/w holding of meeting with the respresentatives of Association

Respected Sir,

The representatives of IP/ASP Association desires to discuss the following items with your honour, as the same are pending since long.

1. Issue of combined seniority list of Inspector Posts cadre from 2000 onwards.
2. Inter Circle Rule 38 transfer cases of Inspector Posts.
3. Merger of Assistant Superintendents Posts Cadre to PS Gr. B cadre.
4. Revision of monetary ceiling of briefcase/ladies purse for official purposes.

Brief note of pending issues that will form part of meeting are as follow:

1. Issue of combined seniority list of Inspector Posts cadre.

The combined All India Seniority List of Inspectors of Posts from the year 2000 onwards was not prepared, released and not placed on India Post website. This issue was importunately pushed by this Association since last several years and also discussed with Hon’ble Secretary (P) on 6/2/2013 and it was assured in the meeting that the seniority list would be made available at the earliest, but Directorate has only released seniority list for the year 1998 and 1999 only. It is therefore requested to kindly direct SPG Division to start the preparation of seniority list of remaining years and made available on India Post Web site.

2. Inter Circle Rule 38 transfer cases of Inspector Posts.

The Directorate vide letter No. A.34013/01/2009-DE/SPB-II dated 5.2.2010 issued guidelines providing for transfer of lady Inspectors of Posts against Direct Recruit / Departmental examination vacancy based on her selection in the respective examination and there after detailed guidelines for Inter-Circle-transfer of Inspectors of Posts under Rule 38 of P&T Manual Vol. IV were issued under No. 141-177/2009-SPB-II dated 14th December 2010. In the said guidelines it is mentioned that the CPMsG of the Circle where the Inspectors of Posts are working would be competent to permit such transfer in consultation with the CPMG of the Circle where the transfer is sought for by the individual. Further, it is also mentioned that the CPMsG should take a considerable view in consultation with their counterpart while considering the request of Inspectors of Posts candidates for transfer to their Home / nearby Circle under Rule 38. Department has further issued instructions to all Heads of Circles under Directorate memo No. 141-114/2012-SPB.II dated 7th May 2012 regarding disposal of the representation for transfer of the circle cadre officials. This Association has pointed out time to time details of several pending cases at various circles to Directorate and requested to reiterate the instructions to all Heads of Circles to consider the Inter-Circle –transfer cases of Inspectors of Posts on the basis of above instructions, but very few Circles have positively responded. The scheme of allotment of surplus qualified candidates has already been quashed out by Directorate in 2010. It is therefore requested to issue instructions once again to all Heads of Circles to consider all pending Inter-Circle transfer cases under Rule 38 of Inspectors of Posts immediately against the vacant posts or on deputation basis in case of non-availability of vacancies. As per the discussion had with your predecessor, this Association has forwarded the consolidated list of surplus qualified IPs to Directorate under letter No.GS/AIAIASP/Rule-38/TFR-IP/2014 dated 20/1/2014.

3. Merger of Assistant Superintendents Posts Cadre to PS Gr. B cadre.
This Association has already submitted a detailed proposal on merger of ASP cadre to PS Gr. B cadre to Hon’ble Secretary (Posts) and as well as to Hon’ble Member (P) under letter No. GS/ AIAIASP / Merger-ASP/2013 dated 20/11/2013. It is learnt that Estt Division of Directorate has called the requisite information from all circles but proposal is not materialized till this date.

4. Revision of monetary ceiling of briefcase/ladies purse for official purposes

Directorate vide letter No. F.No. 15-1/2011-GA dated 26.10.2012 has circulated revised monetary ceiling limit for purchase of briefcases/ ladies purses for official purposes for the officers working in different capacities in Directorate. Whereas similar situated officers working in Circles are being deprived of this revision by Circles. Thus the old ceilings up to limit of Rs.1000/- is still in vogue in most of all the Circles.

IPs/ASPs who are entitled to procure brief cases/ladies purses of their own choice from any of the private/ public outlet are asked to purchase the same from market but thereafter given reimbursement of Rs.1000/- whatsoever cost of the said purchase maybe. No matter even if it does not commensurate to the market price too.

It is therefore humbly requested to your kind honour to pass orders to all circles/regions with the direction to maintain uniformity at all levels as per revised limit contained in Directorate letter ibid. If needs be copy of Directorate letter dated 26.10.2012 may kindly be ordered to circulate amongst all so that circles may not have any excuse to adhere to the prescribed limit.

We hope that your honour will give us an appointment on any convenient date in this month for at least for half an hour. Necessary relief arrangement orders may also be issued well in time.

Subject : Regarding discrepancies in vacancies for Inspector Posts examination 2011 at Uttar Pradesh Circle.

R/Madam,

The IPASP Association brings to your kind notice, the irregularities being committed by Circles whilecalculating vacancies under different mode of promotion. Calculation of vacancies and filling thereof are governed by certain set of recruitment rules which are to be adhered to for a fair play. The basic motto of the DOP&T instructions and rules is to maintain the rota-quota principle i.e. vacancies shall be rotated to ensure that no vacancies remain unfilled if the candidates are eligible in any mode but quota shall also be maintained by restoring the vacancies in the subsequent years.

As for the information of Association, in the last held 2011 Inspector Posts Examination, UP Circle originally communicated vacancy position to Directorate as OC-03, ST-02 and SC-Nil for the Inspector Posts Examination for the year 2011 which was revisited time and again by Directorate vide memo No.A-34012/04/2011-DE dated 22/9/2011 and 29/9/2011.In the process no one questioned the authenticity of vacancies with reference to total number of vacancies in a particular cadre. The vacancies of IP and ASP cadre are clubbed overlooking the fact that IP and ASP are different cadre and governed by different recruitment rules resulting in short/excess recruitment in a given year. This is disturbing position in PS Group “B” and in JTS level too with the result more than 25% posts in the cadre as a whole are lying vacant in circles bringing inefficiency in service.

In UP circle total IP sanctioned strength is reportedly 226 leave aside ASP cadre against which 129 IPs are working leaving 97 vacancies in the vacancy year 2011-12 which was to be filled under different mode in the ratio of 67/33% and clearing backlog if any in the same recruitment year. Moreover service/recruitment rule for the purpose of roster calculation is based on post instead vacancies. In case proper roster is maintained in Circles, there is no question of any wrong calculation but this is not happening in circles that must be subject to scanner.

Some of our members have taken vacancy calculation sheets under RTI which revealed that every time different sanctioned strength is mentioned what to talk of correct vacancy position. Apparently wrong calculation of vacancies is made in UP Circle showing wide gap between working strength and actual strength in IP Cadre. Due to wrong calculation of number of vacancies in IP Cadre, candidates qualified under LDCE 2011 could not be included in the selected merit list which is direct affect on the career progression of the aspirants. As per association expert calculation there should be 44 vacancies instead of 5 as calculated and reported by UP circle for IP Exam 2011. If this situation prevails for long then the day is not too far away when there will be complete chaos in handling charge of divisions and coping with work load.

It is therefore requested to kindly to look in to the matter personally and take appropriate action by summoning all relevant record of the IP Examination 2011 and ordering vigilance enquiry at Directorate level thereto for the natural justice to the candidates qualified under LDCE 2011. Suitable instructions may also be issued to all concerned including DE Division of Directorate to fill all the posts in IP line by calculating correct vacancy position.

Letter to Secretary (Posts) to convene supplementary DPC for PS Gr. B and repatriation of Gr. B officers to their home circle.

Subject: Request for convening supplementary DPC after calculating the actual vacancies including vacancies after repatriation of Group B officer presently working outside their Circles.

Respected Madam,
 
IP/ASP Association would like to bring to your kind notice that supplementary DPC for promotion to the cadre of PS Gr. B for the year 2013 is unnecessarily delayed. Resultantly good number of posts continues to remain vacant in PS Gr. B cadre for months together bringing inefficiency in work culture of department.
It is to further bring to your kind notice that Directorate has not given proper attention to this Association’s letters of even number dated 30/12/2013, 20/2/2014 and 25/3/2014 vide which it was requested to issue orders for convening supplementary DPC for promotion to the cadre of PS Gr. B and consider repatriation of all Group B officers who completed one year in outside Circles. Instead this, Directorate has again unnecessarily called for information about relief / declination of promotions by officers from all circles under letter No. 9-06/2014-SPG dated 7/5/2014, as the same is already available in SPG Division.
 
This Association would like to further add here that supplementary DPC of the left out vacancies from the extended zone of consideration is a part of main DPC and should be convened immediate after completion of one month against left out vacancies so as the officers in the extended zone may not be deprived of their legitimate right and benefits. But despite issue of three reminders nothing is heard in this regard.
 
It is therefore urged to convene the supplementary DPC for the vacancies 2013 immediately and also consider the request of officers for repatriation to their parent circle for the vacancies arising up to May 2014.

An early action is requested.

Subject: Regarding non maintaining uniformity by Circles in making Adhoc Promotion of JTS Group A cadre.

Respected Sir,

The IP/ASP Association intends to bring to your kind notice how Circles are resorting to ad-hoc arrangement in total disregard to the statutory provisions on the subject as well as proper manpower management and career advancement of the employees. As explained in DOP&T’s O.M. No.28036/8/87-Estt.(D) dated 30.03.1988 read with O.M. No.28036/1/2001-Estt.(D) dated 23.07.2001, promotions/ appointments on ad-hoc basis are to be resorted to a post which cannot be kept vacant in consideration of its functional/operational requirement. In our Department, posts of PS Group ‘B’ and JTS Group ‘A’ cadre are of such a nature that these cannot be kept vacant in the larger interest of department and public as well.

Whenever adhoc promotions are found inescapable in selection posts in the exigency of service the same should be ordered only from amongst the senior-most eligible staff. As a rule, a junior should not be promoted, ignoring his senior unless the competent authority ordering the ad-hoc promotion, considers him unsuitable. Certain circles are over sighting these rules while making ad-hoc promotions. Gujarat Circle is set example where S/Shri J. D. Vankar, AD, PTC Vadodara & R. M. Shah, SRM 'W' Division, Vadodara are still working in PS Gr. B cadre and their juniors are working in JTS Group A cadre on adhoc basis since long. It means that inter-se-seniority has not been taken in to consideration while making the ad-hoc arrangements in JTS cadre at Gujarat Circle. This situation is arises because of non-convening of JTS Gr. A DPC on time. In most of the circles more than 50% JTS and STS posts are vacant. JTS Gr. A DPC for the year 2012-13 and 2013-14 and supplementary DPC for PS Gr. B cadre for 2013 are pending.
This Association therefore requested your honour to kindly issue instructions to all the circles to fill short term vacancies of JTS Gr. A cadre on ad-hoc basis according to the guidelines issued by DOP&T and as per the inter-se-seniority cum fitness at the earliest and convene pending DPCs (JTS Group A and Supplementary PS Gr. B) for career advancement of the employees and to avoid ad-hoc arrangements that is otherwise also creating ambiguities.
