e-MAIL TO GS TO AVOID ANOTHER LITIGATION

Revised Category wise break up under 6% quota may be partially modified for PS Group ‘B’ LDCE but this revision was not demanded in the OA. This was infact a part of second relief sought in the original OA wherein quash of Sr. Postmaster(Group B Gazetted), Postmaster( Grade III and II-Group-B non- Gazetted) and Postmaster Grade-I Group C Recruitment rules, 2010 was requested. As per these statutory rules all the 116 Sr. Postmaster posts mention therein are to be carved out from General line but instead the quota of the Inspector line has also been reduced from 19% and 75%. In General line quota there are only 52 posts (6%). Hence these rules become redundant. The relief for change in statutory rules is a subject matter of long discussion so we will have to file a separate case for that. To avoid litigation, I had long discussion with you and you had assured me to go to Directorate to discuss the matter and get the things set right amicably.I again through this email request you to kindly submit a representation to Dte. with the request to post all General line aspirants as Sr. Postmaster, as the PS Group B posts in their quota are already full, rather 4 officers (27 -23) are working in excess if we go by the recruitment rules of 2010 though these are running contrary to PS Group B recruitment rule 1987. If there is a litigation than our demand will be to fill up 52 posts of Sr. Postmaster from General Line and rest 64 posts from 19% IP line LDCE quota. If we go by Postmaster recruitment rule 2010 there are two quota 25% of 116 i.e 29 posts are earmarked for General line and 75% all through competitive examination from IP line. In case department goes against the statutory rule framed by them we will have no option except to file another application in the Hon'ble CAT for relief and justice.

MORAL WIN

Today the case was heard before Hon'ble CAT Bench at Chandigarh. Arguments started at 1050 hours and ended at 1120 hours. The officers of Directorate were present to explain their position. Finally our stand has been vindicated and we have come out with flying colours. Hon'ble Court has allowed the OA with the directions to DOP to recalculate, re-examine the vacancies as per respective quota in each category out of the total posts. If still there is any vacancy, only then the DOP can conduct PS Gr B examination scheduled to be held on 29.05.2011. It is hoped that atleast now the Department would realize the pain of IP/ASP and certainly improve their mathematics. A major win has boosted the morals of our comrades. We are highly greatful and thankful for all the moral support extended by our fellow comrades.

CAT CASE UPDATE

Yesterday and again today our case was heard in detail. The Hon’ble CAT asked the respondent to explain the methodology they adopted to calculate the vacancies. The department could not explain their position as their own reply is contradictory and they sought time. Thereafter two call were given to argue the case and explain their position. Department evaded their presence and sought adjournment by sending their proxy counsel. Hon’ble court has adjourned the case for tomorrow. Now there is move that officers from directorate will appear personally to defend the case.

SELF MOTIVATION

Homer Rice said, “You can motivate by fear. And you can motivate by reward. But both of these methods are only temporary. The only lasting thing is self-motivation.”
My learned comrade from odisha examined the above quote in the context of DOP and other younger respectable comrade from Karnataka valued it in his blog. It is fact that Motivation stands for the state of organism which involves the existence of a need that moves or drives him from within towards a goal for the satisfaction of the desired need. It is the IP cadre that works day and night to achieve the goal for the welfare of the department only but it is the department that never valued it. This cadre is like a bird that collects the material to build its nest in the upper corner of a drawing room. After looking at it the owner of house try to remove it. But the bird again brings the small pieces of leaves etc and engages itself in building its nest. What makes it so much hard working? It is the point to think .Now you take few point from the desk of our General Secretary whose view point on IPASP blog reflects his clumsy vision and inert emotion towards buoying the cause of our cadre. Is it not the duty of association to fight for our rights including IP GP issue? Yes, it is our duty to motivate and exhort our members to fight for our rights. Our central leadership should fight for GP issue instead of looking towards the officers sitting at the helm of affair. Why is this not being done and why our CHQ is not asking the kerala leadership to stand by Sh. Permanand and file application for early hearing?  But it is deplorable that we are still living in the era of fear, materialism and sycophancy. It can be concluded easily that association now-a-days has become only a mode of excursion or extra curricular activities instead of showing true spirit of leadership. Our GS is saying that there will not be any chance for further postponement of PS group “B” examination. Dear Secretary don’t worry, in case you are afraid of any thing Punjab Circle is still with you. We in our application have never demanded postponement of exam. Rather we are fighting for justice within quota. In case there are vacancies in 6% and 19% quota, there must be examination. If there is no vacancy for what examination is being conducted. Punjab will not allow repetition of the old mistakes and fight for justice, come what may be the results.
If you are thinking that Punjab is not fighting for the justice, CS Punjab is ready to resign from the association. Otherwise also time has come when I should step-down  to allow younger IPs to takeover. After 24th I will decide my next course of action on this. In the last but not least I will like to say that always remember this quote.

CAT CASE UPDATE

CAT case filed in Chandigarh bench was listed for today. The case has been adjourned to 24.05.2011 after having assurance from the department that they will file written reply before the next date of hearing. If department failed to do so we will request Hon’ble court to provide interim relief . In case the department filed the reply the case will be heard on merit.

I am receiving number of calls from my esteemed members to know the nature of case we have filed, whether it is against the PSS Group “B” examination or postmaster cadre. It is for the information of members that the case is neither against any examination nor postmaster cadre. We are fighting for correct calculation of vacancies under each quota and promote the IP/ASP in their respective quota of vacancies. You will agree that there are 866 PSS Group B post, Out of which 649 (75% of total strength) posts have been earmarked for the promotion through seniority cum fitness, 165(19%) through Departmental Limited Competitive Examination from IPO line and 52(6%) from General line official through examination. Now since Postmaster cadre has been carved out by creating 116 posts from general line (see Notification) then why and how the exam is being conducted for 6% general line officials. As far as 19% quota is concerned the roster for this quota is already full. At present 162 of 165 posts are filled, how 32 vacancies have been calculated by the department. Finally we have demanded that there should not be any effect on 649 post earmarked for promotion through seniority. Examination should be held if there is any vacancy in their respective quota and distribution of examination should only be within 25% without effecting 75% quota.
