Reply to Query on RR

Dear Pavan Kumar and fellow comrades,
Hon’ble Supreme Court in its judgement in R K Sabharwal’s case has ruled in favour of a change over from the existing “vacancy” based reservation roster to “post” based roster. In compliance to it, “the quota of percentage of departmental promotees and direct recruits has to be worked on the basis of the roster point taking into consideration vacancies that fall due to the vacancy at the given point of time……”. The term ‘cadre strength” referred to in DOPT O.M. No. 36012/2-97-Estt dated 2.7.1997 in relation to calculation of reservation/ maintenance of roster means the number of posts required to be filled by a particular mode of recruitment in term of applicable RRs. When recruitment is made vacancy based, it is possible that at any given point of time, the share of direct recruitment may increase and the share of promotion may correspondingly decrease or vice versa.  In such cases cadre strength for direct recruitment and cadre strength for promotion varies from year to year as is being done in PA cadre where element of direct recruitment is involved and given in the RR. But this is not possible in the case of PS Group B as its RRs explicitly prescribes ‘Total posts’ and not ‘Total Vacancy’, refer Column 12 of the RRs, as also extracted hereunder:-   
By promotion
75% of the total posts shall be filled by promotion from amongst Inspectors of Post Offices and Inspectors of Railway Mail Service (Pay scale Rs.1400-2300/-) with 8 years regular services in the grade.
Promotion by examination
(i) 19% of the total posts shall be filled on the basis of a departmental competitive examination from amongst Inspectors of Post Offices and Inspectors of Railway Mail Service (Pay scale Rs.1400-2300/-) with five years regular service in the grade.
(ii) 6% of the total posts shall be filled on the basis of the same departmental examination from amongst clerical line officials working in Post Offices/Divisional Offices with 5 years regular service in the Lower selection Grade and above”.
Apparently, in RRs of PS Group “B”, 19% (IP line) +6 %( General line) i.e. 165 posts + 52 posts (not vacancies occurred in a particular year) respectively will be filled through LDCE and rest of 649 posts will be filled through DPC. In simple way, vacancies could only be calculated within 165, 52 and 649 without increasing or decreasing the roster. In case five posts have been vacated in a particular roster, the vacancies pertaining to that roster can be advertised in that particular quota thus, transfer of vacancies to other quota would be violation to RRs. In the vacancy year 2011, 162 points were occupied in 165 point roster but department increased the roster to 192 without sanctioning new post in the cadre which was against the RR. Hon’ble CAT after going through DOPT letter and relevant RRs held to revisit the calculations. You will agree that if vacancies are worked out on the basis of vacancies occurred in a particular year than a day would not be far when all the posts will be occupied through LDCE, thereby squeezing the promotion quota, hence there will not be any promotion either through LDCE or DPC. Yes for now, It will be a golden chance for youngster to come forward and become PS Group “B” officer. Needless to say, there will not be further promotion for PS Group “B” in Group ‘A’ because of the RRs of Group A which prescribes restriction of these promotes PS Group B to 33.33% Group “A” posts only and their road will end. Apparently Group “B” will retire as Group “B” and Group ‘A’ in the same capacity. Only Direct officers of Group A will get promotions under 67% quota.

Yes, this elaboration would absolutely clarify the ambiguity created in the minds of some of our fellow comrades. Perhaps, now the concept would be clear. Thanks to Harimohan ji and ASP from CEPT. Without amending the RRs of Gr B, DOPT letter ibid cannot be followed and moreso it is also not in the interest of a particular cadre. When we are thinking of following post based roster with great intent, we have to fill up all the vacancies once through backlog recruitment. Only thereafter the event will happen, when the reserved candidate would fill the reserved post only and General candidate shall replace the retired candidate only. Unless and until the roster is filled upto brim, implementation of post based roster is nightmare.

Dear Sir,
The RRs of Group A posts does not restrict the PS Gp B quota to 33.33% but it is 75%. Please make correction. (Ref : Para 3 of Notification to be published in Part II, Section III of Gazette of India dated 18-3-97 issued by the Dept which reads as under :-
"The number of persons recruited in a year under clause (i)
above shall not exceed 25% of the total regular posts in
Junior Time Scale, the remaining posts being filled by
promotion from Group ‘B’". Here clause(i) denotes the direct recruits(IPOs officers).

Sir,
Kindly refer to notification 18-03-1997 vide which rule 5, in sub-rule(1), for clause (a) sub-rule (1) of rule 5, has been substituted, Para 3 (a) (iv) prescribes a provision to the effect "the total number of promottee officers in various grades of the Service shall not, at any time, exceed 33-1/3% of the total cadre strength (excluding training reserve)".

Apparently, there is absolute restriction for promotee officers to whole cadre strength in Gr A amongst various grades in this amendment.

The things would be clear and unambigous now.

Dear Sir,
Kindly go through para 4 of the above notification dated 18-3-1997 which read as under :-
para 4. In Rule 20 of the said rules for sub-rule(8), the following shall be
substituted, namely:-
“(8) Where juniors who have completed their qualifying/eligibility
service are being considered for promotion, their seniors would also
be considered provided they are not short of the requisite
qualifying/eligibility service by mores than half of such
qualifying/eligibility service or two years, whichever is less and have
successfully completed their probation period for promotion to the
next higher grade along with their juniors who have already
completed such qualifying/eligibility service.”
From the above it is evident that All the PS Gp B officers promoted to JTS cadre would automatically become STS/JAG etc whenever their junior direct recruit (IPOs officers)are promoted to such cadre. Hence there should not be any fear about the restriction in availability of vacancies in STS/JAG provided the PS Gp B officers should have enough service left to occupy the above posts.

from the above publication and comments on the publication, it is not clear whether promotional avenues are available to PSS Gr B officers. Kindly guide in this regard so that many young IP chaps will not refrain themselves from writing the examination.

Dear IP Andhra,
The better person to decide the issue is "you" only. Being a Group B Officer I would surely recommend you to write the exam whenever the opportunity arises. Don't worry about the promotional aspects. Apart from this, One question I wish to ask you is that While writing the IP exam, what was your thought? Wasn't it that one day we will become a divisional head(SPOs)after coming out successful in this (IP exam)? If it was not, then don't write the exam and be an ASP for life long (till the dept thrown out you at 60) and GP 4800 will be given to u without much efforts.On the other hand, if it was your wish to become an SP which driven you to write the IP exam, then don't waste the golden opportunity of appearing PS Gp B Exam.
As regards to avenue for promotion, once you become an conferred IPOs officer (JTS) and join the elite club, then there will be no problem for us(i.e the promotee officers/conferred IPOS officers)to fight for the promotional avenues as it would be looked in to by the direct IPOS officers as both IPOS officers(Direct/conferred) will find their place in the common seniority list only.
